Delegated Authority Cities

The jurisdiction of the State Fire Marshal encompasses the entire State except for those that have been granted Delegated Authority. In these areas, plans should be submitted to the Delegated Authority in lieu of the State Fire Marshal's Office.
***State-owned properties and federally certified health care facilities (CMS certified) are exempt from Delegated Authority jurisdiction. Plans for these facilities should be submitted to the State Fire Marshal***

In accordance with State Statute 81-502, the State Fire Marshal has delegated authority to local fire prevention personnel in nine cities of the state. These individuals have the authority to carry out many of the responsibilities of this office within their respective city limits. The State Fire Marshal retains the ability to overrule a decision, act, or policy of the local personnel.

Note: As of June 8th, 2023, Scottsbluff is no longer a Delegated Authority.

Local Authority Cities and Counties

Local Authority cities and counties conduct the Accessibility Code Review (NAG Review) in lieu of the State Fire Marshal's office. Please always double check with the city or county before submitting as Local Authority can change without notice.
***State-owned properties, and federally certified health care facilities (CMS certified) are exempt from Local Authority jurisdiction. If a NAG Review is required for these facilities, the State Fire Marshal's Office will conduct it.***
